New-Build Driveway Defects: What NHBC Warranty Actually Covers

New-build estates across Essex and East London have grown fast over the last couple of decades, and a common assumption catches owners out: that anything wrong with a five-year-old driveway is automatically the developer's problem to fix. It usually isn't, and knowing where the line falls saves a lot of wasted correspondence.
What NHBC and similar warranties actually cover
New-build warranties (NHBC being the most common, though LABC and Premier Guarantee also appear) typically split into a shorter builder's warranty period covering most defects, and a much longer structural warranty covering major structural issues only - not general wear or routine maintenance items. A driveway mostly falls under the shorter initial period unless the defect is genuinely structural, such as a design fault in the drainage that a developer should reasonably have avoided.
Common driveway issues on newer estates
- Undersized or poorly designed drainage - occasionally a genuine developer fault, worth raising within the warranty period if water consistently pools in a way that seems disproportionate to rainfall
- Thin sub-base from rushed installation during a fast build phase, which shows up as early cracking or sinking within the first few years
- Block paving laid without adequate edge restraint, leading to blocks spreading at the perimeter earlier than they should
What's genuinely just maintenance
Weeds appearing in joints, jointing sand needing its first top-up after a few years, or general surface wear from weather aren't warranty issues - they're the same maintenance every driveway needs, new-build or not (see our maintenance guide).
If you think it's a defect, not maintenance
Raise it in writing with the developer or warranty provider promptly, with photos and dates, rather than waiting - most warranty periods have specific windows, and a defect reported after the relevant period has closed is much harder to pursue regardless of how genuine it is.
